This agreement contains the entire understanding between
Fox Creative Design Ltd (FCD) and THE CLIENT.
Pre-Wedding Consultation: The parties agree to a pre-event consultation two to three weeks before the event in order to finalize the actual shooting times, locations, and CLIENT's written request list for specific photographs.
Cooperation: Every couple has individuals that they want included in photos. As Fox Creative Design cannot know who these are, FCD recommends that the CLIENT designate an "event guide" to point out important family members and friends to be included in the candid and informal photos. Very important people, such as grandparents, siblings, etc, can be given a simple flower to wear. Every time the photographers see someone with a flower, several photos will be taken. The duties of the "event guide" will continue into the formal photo session, where he/she will be responsible for having the individuals mentioned in the CLIENT's photo list at the proper location at the correct time. The photographers will not be held accountable for not photographing desired people if there is no one to assist in identifying people, or gathering people for photographs. FCD is not responsible if key individuals fail to appear or cooperate during photography sessions. It is advisable to have a designated "event guide" from both the bride's side and the groom's side, and that they be given a copy of the CLIENT's written list. Beginning the photo session on time is critical on the wedding day, as loss of time means lose of photo opportunity.
Time Commitment on the Wedding Day: Of paramount importance to FCD is the dedication of a minimum of one full hour to just the bride and groom, away from everyone else. The Client agrees to give at least one hour of photo time to create these images. This will be above any driving time. The bridal party images should take anywhere from 30minutes upward depending on style and locations. Immediate family will need about 20 minutes. Extended family timing is dependant on the amount of poses and groupings required.
Restrictive Rules: Each ceremony officiant has his/her own list of restrictions. Please check with your officiate as soon as possible and advise FCD about the "house rules." The photographers are limited by these guidelines. The CLIENT agrees to accept the technical results of the officiant’s restrictions on the photographer. Negotiation with the officials for moderation of guidelines is the CLIENT's responsibility, although FCD will offer technical recommendations. Occasionally, hotels, and other venues have restrictions, and it is advised that you ask if your venue has any limitations on photographers. If you are including the "Getting Ready" images into your package, please check with your hair stylist, and make-up artist prior to booking your appointment.
Limit of Liability: In the highly unlikely event that the photographers are injured, or become too ill to fulfill the contract, every effort will be made to secure the services of another qualified photographer to cover the event. If the situation should occur and a suitable replacement can not be found, responsibility and liability is limited to the return of all payments received for the events package. Fox Creative Design Ltd takes the utmost care with respect to exposure, transportation, and delivery of images/photographs. However, if the unlikely event of the files being lost, stolen, or destroyed for any reason, the liability for FCD is limited to the return of all payments received for the event package. Partial loss of files shall be a pro-rated amount of the exposures lost based on the percentage of total number of originals. FCD agrees to re-photograph, within reason, any simulated situation. After the CLIENT has chosen the images to be used in the wedding album, the CD/DVD of jpegs will be given to them. We recommend that these files be copied and given to other family members for safekeeping. Be certain to update the CD/DVDs as new technology becomes available to ensure that your files are protected and preserved. After the CLIENT receives the album and the CD/DVD, FCD will remove the files from their computer system and place them into storage. When the CLIENT receives the files, the liability for keeping and storing the files by FCD will cease.
The Copyright of the Files: The copyright of the images will remain the exclusive property of Fox Creative Design Ltd. and can be used for advertising, accreditation, and competition, in print form and on the web site. This contract gives to the CLIENT "home rights" to the images which includes the right to print, and place on their website any/all images. The disc can be copied to facilitate storage in other locations. Your family may print and place on their website any/all images. Because FCD is the exclusive holder of the copyright to these images, the CLIENT or anyone else, may not sell these files/images/prints, or use them for commercial use without our permission, nor can the files/images/prints be used as the basis for any creation of artwork.
The Model Release: The CLIENT, both bride and groom, give to Fox Creative Design Ltd the exclusive copyright of all images taken at the contracted events, and grant to FCD unrestricted permission to use the files/images/photos for advertising and promotion, for professional accreditation, for competitions, and for publication.
The Retainer: A signed contract and a retainer of 50% plus GST is required to secure your wedding date. This retainer is fully refundable within 30 days of signing the contract. Because FCD will immediately reserve the date, turning down all consultations and will not make any other arrangement for that time, the retainer is non-refundable after that 30 days. Should the wedding be cancelled, or moved to a day FCD has already reserved for another couple, the CLIENT may use the retainer for any type of general portraiture, and/or products offered by Fox Creative Design.
The Album Design: The CLIENT agrees to pick out the chosen images for the album within 6 weeks of the images going on-line. If this has not been done, the album design will proceed using the photographer's choices as stated in the "Album Design Procedure."

Our retainer of $_________________ is hereby given to Fox Creative Design Ltd. to reserve the date of our wedding. We understand that, after thirty days from signing this contract, the retainer will not be refundable, as FCD will turn down any and all photographic assignments on our chosen date. We will pay the remaining 50% of the package, plus GST, two weeks prior to the wedding day.
We have read this entire contract and understand the terms above. We agree to the terms of this contract.
